Jain ‘munis’ on Tuesday demanded a decision of the civil court within two days in the case of Seth Hirachand Nemchand Digambar (HND) Jain Boarding and Temple case. Acharya Guptinandhi Maharaj said that a petition was filed in the civil court 10 days ago after the Charity Commissioner of Maharashtra approved the cancellation of the property sale contract between Seth Hirachand Nemchand Samarak Trust and Gokhale Landmarks LLP on October 30. He said the proceedings were moving at a slow pace and said the “monies” would continue to protest if a decision was not made in the case by Wednesday.
“The Charity Commissioner said the cancellation should be done as soon as possible. But it has been delayed for 10 days now. This is disrespectful to the court, to the Maharashtra government, and to the order of the Charity Commissioner. The builder and trustees have now filed an appeal in the civil court. There is a saying ‘Jab mian biwi razi toh kya karega qazi’,” he said.
“I would like to appeal to the judge that an immediate decision should be taken in this matter and we should get final cancellation of the legal bond today or tomorrow. Otherwise, we saints have given our word and this has already been prescribed. Our Grand Master said that if this deal is not canceled soon he will protest in front of the Prime Minister’s House,” Guptinandi added.
Maharashtra Charitable Trust Commissioner Amogh S Kaloti, in an order issued on October 30, canceled the sale after both the Trust and Gokhale Construction agreed to withdraw the deal. “(The two parties) must take appropriate steps and measures to cancel the deed of sale and power of attorney dated 10-08-2025. Such steps and measures must be taken as soon as possible,” the order said.
“They have filed an application in a civil court on the basis of the Charity Commissioner’s order. Hence, they will have to file an application before the civil court to get the cancellation order. They will have to get a declaration of mutual consent from the civil court,” lawyer Yogesh Pandey, who represents petitioner Sukhaushal Ginturkar, told The Indian Express.
“They submitted the application yesterday evening. Acharya says these things are moving at a very slow pace. Ideally, it has been decided that everything will be sealed within 15 days. But now there are only 4-5 days left and if they are moving in this late manner, we don’t know what is going on in their minds. There is anxiety in the community,” Pandey added.
The sale of HND Jain Boarding and Hostel by the trustees to Gokhale Construction has led to a major controversy. MP Muralidhar Mohol from Pune came under fire over his links to the construction company, which said he parted ways with the company 11 months ago. Opposition Congress leader Akshay Jain and his ally Shiv Sena leader Ravindra Dhangekar launched attacks on Mohol. Finally, the two parties decided to cancel the contract.
