NIA asks Delhi HC to hear Yasin Malik terror financing case away from public eye | delhi news

The National Investigation Agency (NIA) on Monday verbally asked the Delhi High Court not to conduct open court proceedings while hearing the agency’s appeal seeking death sentence to jailed Kashmiri separatist leader Yasin Malik in the 2016 terror financing case.

The application was filed by Special Public Prosecutor (SPP) Akshay Malik, appearing on behalf of the NIA, before Justices Vivek Chaudhary and Manoj Jain. SPP Malik verbally requested: “Don’t be in open court, please provide a separate link (for Yasin Malik to appear).”

Yasin is appearing before a Delhi court and appears via video link from Tihar Jail.

The request came as the NIA sought adjournment of the case on Monday, to respond to the allegations made by the separatist leader in an affidavit submitted to the Delhi HC in a sealed cover in August.

Justice Chaudhry commented orally that he would consider the NIA’s request. The bench has now adjourned the matter for consideration on January 28 next year.

Yasin, despite agreeing to the NIA’s request for postponement, requested that his case be heard as soon as possible. He verbally told the court: “Mere ek hai request hai, ek chaaks ko psychological torture mein rahna… toh jalad se jalad sunye isi please (I have only one request, it is psychological torture to keep a person in jail, so please listen to my case as soon as possible).”

Yasin, in his affidavit, is learned to have said that the state encouraged him to keep the peace track alive in Jammu and Kashmir, claiming that he was actively involved by seven prime ministers in the past and also held talks with the RSS leadership and two Shankaracharyas.

Yasin, who has been in Tihar jail since 2019, had submitted the affidavit in a sealed cover after the NIA requested that the life imprisonment sentence be increased to death in the terror financing case.
